By accessing or using Aether AI Support, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service. These terms include important provisions regarding limitation of liability, dispute resolution, and arbitration that affect your legal rights.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Aether AI, Inc. ("Aether AI," "we," "our," or "us") governing your access to and use of the Aether AI Support platform, including our website, APIs, embeddable widgets, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use after such notification constitutes acceptance of the modified Terms.

Features and availability may vary based on your subscription plan. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Accounts & Registration
To use the Service, you must create an account. By registering, you agree to:
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.
4. Billing & Payments

Payment Terms
- • Subscriptions are billed monthly or annually in advance
- • Payment is due upon subscription and at each renewal
- • All fees are non-refundable except as required by law
- • Prices may change with 30 days' notice
Automatic Renewal
Subscriptions automatically renew unless cancelled before the end of the billing cycle. You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.
Overages
If you exceed your plan's limits, we will notify you. Additional usage may be charged at our then-current overage rates, or you may be prompted to upgrade your plan.
5. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all content and activity under your account.
You May:
- Use the Service to provide customer support for your business
- Upload and manage your own content in the knowledge base
- Embed the widget on websites you own or control
- Use our APIs in accordance with our documentation
- Customize the appearance to match your brand
6. AI-Generated Content
Important Disclaimers
- No Guarantee of Accuracy: AI-generated responses are based on your knowledge base and may contain errors, omissions, or inaccuracies.
- Human Oversight Required: You are responsible for reviewing AI outputs and ensuring they are appropriate for your use case.
- Not Professional Advice: AI responses should not be relied upon as legal, medical, financial, or other professional advice.
You acknowledge that AI technology has inherent limitations. We continuously work to improve accuracy but cannot guarantee that AI responses will be error-free or suitable for all purposes. You agree to implement appropriate safeguards and human review processes for critical use cases.
7. Your Content
Ownership
You retain all ownership rights to content you upload, including knowledge base documents, FAQs, and other materials ("Your Content"). We do not claim ownership of Your Content.
License Grant
By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and display Your Content solely to provide and improve the Service. This license terminates when you delete Your Content or close your account.
Your Responsibilities
You represent and warrant that: (a) you own or have rights to upload all content; (b) your content does not violate any laws or third-party rights; (c) your content does not contain malware or harmful code; (d) you have obtained all necessary consents for any personal data in your content.
8. Prohibited Activities
You agree NOT to use the Service to:
Violation of these prohibitions may result in immediate termination of your account without refund, and we reserve the right to pursue legal action where appropriate.
9. Termination
By You
You may cancel your subscription and close your account at any time through your account settings. Cancellation takes effect at the end of your current billing period. You remain responsible for any outstanding charges.
By Us
We may suspend or terminate your account immediately if you: violate these Terms; fail to pay required fees; engage in fraudulent or illegal activity; or pose a security risk. We may also terminate for convenience with 30 days' notice.
Effect of Termination
Upon termination: your access to the Service ends immediately; we may delete your data after 30 days; any licenses granted under these Terms terminate; provisions that should survive (liability, disputes, etc.) will continue.
Data Export
Before termination, you may export your data through the Service. We recommend downloading your data before closing your account, as we cannot guarantee data availability after the 30-day retention period.
10. Limitation of Liability
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Limitation
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AETHER AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by applicable law.
11. Dispute Resolution
Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at legal@aetherai.support to attempt to resolve the dispute informally. Most disputes can be resolved through good-faith discussion.
Arbitration
If informal resolution fails, disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will be conducted in English in New York, NY. The arbitrator's decision is final and binding.
Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION. This waiver applies to the fullest extent permitted by law.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of courts in New York, NY.
12. Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Aether AI.
Severability
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
Assignment
You may not assign these Terms without our consent. We may assign our rights and obligations freely.
Waiver
Our failure to enforce any provision does not constitute a waiver of our right to enforce it later.
